C. Service Requests, Appointments, and Work Authorization

Submitting a service request does not create a contractor-customer relationship, guarantee an appointment, or obligate Gardner Electrician to perform work. An appointment is subject to confirmation. Arrival times and service windows are estimates and may change because of traffic, weather, emergency calls, technician availability, parts availability, utility conditions, or circumstances outside our control.

A technician may need to inspect the property before confirming the scope, price, materials, schedule, or feasibility of the work. No electrical work will be performed without authorization from a person who has legal authority concerning the property. A binding service agreement may consist of a signed work order, accepted estimate, electronic authorization, recorded authorization where lawful, invoice terms, or another written agreement issued by Gardner Electrician.

Additional or changed work requires further authorization. If unsafe, concealed, non-compliant, damaged, inaccessible, or unexpected conditions are discovered, work may be paused or the scope and price may be revised. We may decline or stop work when conditions are unsafe, unlawful, outside our licensing or service scope, or inconsistent with professional standards.

D. Estimates, Pricing, Payments, and Cancellations

Any price range, starting price, telephone quote, online estimate, or preliminary estimate is informational and non-binding unless expressly identified as a fixed written price. Final pricing may depend on an on-site inspection, diagnostic work, labor time, property access, system condition, code requirements, permit or inspection fees, utility coordination, material availability, equipment specifications, taxes, disposal, after-hours service, travel, and additional work authorized by the customer.

Diagnostic, dispatch, trip, consultation, emergency, cancellation, or after-hours fees may apply when disclosed before or during scheduling. Unless a written agreement states otherwise, payment is due when invoiced or upon completion of the applicable work. You agree to provide accurate billing information and authorize charges approved in the work order or other service agreement.

Payments may be processed by third-party payment providers. Chargebacks or payment disputes do not eliminate amounts lawfully owed. Past-due balances may be subject to collection costs, interest, liens, or other remedies where permitted by applicable law and disclosed in the service agreement.

Cancellation and rescheduling requirements may be stated during booking, in an estimate, or in a work order. We may charge a disclosed fee for late cancellation, missed appointments, special-order materials, permit expenses, mobilization, or work already performed.

E. Customer Responsibilities

You agree to provide complete and accurate information about the property, electrical issue, known hazards, prior work, equipment, access restrictions, occupancy, animals, and any condition that may affect safety or service. You must provide safe and reasonable access to the work area, electrical panels, equipment, crawlspaces, attics, utility areas, and other necessary locations.

You are responsible for securing permission from the owner, landlord, property manager, homeowners association, tenant, or other authorized party when required. Unless a written agreement states otherwise, you are responsible for permit, inspection, utility, association, and access requirements applicable to the property, although Gardner Electrician may assist with these matters.

You must keep children, pets, occupants, customers, employees, and visitors away from active work areas. You must follow reasonable safety instructions provided by the technician. You must not energize, alter, cover, use, or allow another person to modify unfinished work or equipment that has been tagged, disconnected, or identified as unsafe.

You are responsible for backing up or protecting sensitive electronic equipment and data before electrical work begins. Power interruption, testing, surges, equipment shutdown, or disconnection may affect computers, security systems, appliances, medical devices, internet equipment, automation systems, refrigerated items, and other property.

F. Prohibited Activity

Violation of any of the following may result in suspension or termination of access to the Website:

The parties will attempt in good faith to resolve the dispute for at least 30 days after receipt of the notice.

Except for eligible claims filed in small claims court and claims seeking temporary or emergency injunctive relief concerning unauthorized use, security, or intellectual property, any controversy or claim between you and Gardner Electrician arising from or relating to the Website, these Terms, or communications initiated through the Website will be resolved by binding arbitration before a single arbitrator under the JAMS Consumer Arbitration Minimum Standards and applicable rules.

Arbitration will take place in MA, remotely, or at another mutually agreed location. The arbitrator may award the same individual remedies that a court could award, subject to these Terms and applicable law. Judgment on the award may be entered in a court with jurisdiction.

Class-Action and Jury-Trial Waiver: To the fullest extent permitted by law, you and Gardner Electrician waive the right to a jury trial and agree that claims will be brought only in an individual capacity. Neither party will pursue claims on a class, collective, consolidated, mass, or representative basis.

Arbitration Opt-Out: You may opt out of this arbitration agreement by emailing info@gardnerelectrician.com within 30 days after you first accept these Terms. Your notice must include your name, contact information, and a clear statement that you opt out of arbitration. Opting out of arbitration does not affect the remaining Terms.

If any portion of this arbitration section is found unenforceable, the remaining portions will remain effective to the fullest extent permitted by law. If the class-action waiver is found unenforceable for a particular claim, that claim must proceed in court and not in arbitration.

O. Miscellaneous

Nothing in these Terms creates a partnership, joint venture, employment, agency, fiduciary, or franchise relationship between you and Gardner Electrician. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms as part of a merger, reorganization, asset transfer, financing, or other business transaction.

If any provision is held invalid or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. These Terms, the Privacy Policy, and any applicable written estimate, work order, invoice, warranty, or service agreement constitute the relevant agreement between the parties concerning their subject matter. When a written service agreement conflicts with these general Website Terms regarding paid work, the written service agreement controls for that work.

The Website is controlled from the United States. We do not represent that the Website or services are appropriate or available in every jurisdiction. You are responsible for complying with laws applicable to your location.
